  • Non-Compete  A supply company's delivery driver raised questions about an order placed by a competitor.  The company looked into the order and found that the sales rep which initiated the order was a friend of the owner of the competing firm.  Other records were soon found showing orders by the competitor which were filled at discounts by the sales rep.  During this time, laptops used by the sales reps were being replaced with newer models.  The old laptop was provided to M.I.S.C for forensic examination.  The examination revealed a sales history going back three years as well as a second business run by the sales rep in partnership with the competing supply company.  The sales rep used a variety of email addresses to communicate with associates, vendors, and customers on the computer provided by his original employer.
  • Non-Compete  The subsidiary of a grocery distributor lost 3 key employees on one day when they all resigned on a Friday afternoon.  Clients of the distributor reported that the employees went to work for a competitor on the following Monday.  MISC's forensic examiner flew to Miami, took forensic images of four computers and returned to Jacksonville to complete the analysis.  The analysis showed numerous emails between two of the employees and the competitor showing their plans for leaving our client.  Other records showed the dates and locations of meetings and the names of employees of the competitor who were involved in the negotiations.  Many of these details were unknown to our client before the forensic analysis.
  • Policy Violations  A mid-level manager for a large brokerage firm was fired for possessing pornography on the company computer.  The manager claimed the pornography originated on subordinates' computers and that he viewed it while examining their email.  Part of the manager's responsibilities included reviewing emails of other employees for violations of company policy.  The internal network was configured in such a way that he could view their email through a web browser.  The company's forensic report, upon which his termination was based, showed the presence of pornographic images in the Temporary Internet Files folder on the manager's computer but stated that no such images were found in the other employees' computers.  Our forensic examiner was able to show that the other employees did receive pornographic images, that there were records of those images in the company's email stores which they overlooked, and that images on the manager's computer did come from reviewing the emails of subordinates.
